Legal Justification
The reasons for the modification are consistent with the derogation grounds in Article 72(1)(c) of Directive 2014/24/EU (reg72(1)(c) Public Contracts Regulations 2015 as amended) as all of the following conditions are fulfilled. The need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; during the standstill period a bidder to the tender sought further information and clarification to the tender process. The framework was extended to allow SUPC sufficient time to ensure that a full response was provided to the bidder and to allow the bidder time to review the response from SUPC and seek further clarification if so required. The modification does not alter the overall nature of the contract, the overall nature of the contract is unaltered, lots, economic operators and subject matter of the contracts. Any increase in price does not exceed 50 % of the value of the original contract or framework agreement.
