Legal Justification
Direct award due to reasons of extreme urgency — (Reg 32(2)(c) and 32(4)) 1) There are genuine reasons for extreme urgency, The Covid-19 situation has meant that we have needed to respond to consequences immediately because of imminent risk to public health. Public Health guidelines set out the requirements for front line key workers in respect of PPE. The supplies to be purchased as part of this request are necessitated by the Covid-19 emergency in order to meet public health guidelines, to protect both the ESCC and independent sector staff providing services to East Sussex residents, and also to protect the service users themselves and to minimise the transmission of Covid-19. 2) The events that have led to the need for extreme urgency were unforeseeable, The Covid-19 crisis has arisen in the very recent past, with the first UK contracted case being reported as recently as 28th February. Since that time the spread of the disease and measures to combat this have developed rapidly and could not have been foreseen. The European commission has accepted that the emergency services and supplies that have arisen as a result of Covid-19 were not foreseeable. 3) It is impossible to comply with the usual timescales in the PCRs, The crisis has led to huge demand for items of PPE on a global basis, with supply shortages and fierce competition for organisations to secure the PPE that they require. This means that sources have to be assessed and purchases made within very short timescales, sometimes within a few days, in order to secure supplies. There is no opportunity to undertake formal procurement process in the current market conditions, even using reduced timescales. 4) The situation is not attributable to the contracting authority, Covid-19 has led to a range of emergency measures being taken across government and the health and care sector, both nationally and globally. It is therefore not something which is attributable to ESCC. There was no way for the Council to have foreseen the need for such equipment, and the Council has taken a reasonable response to an unprecedented global pandemic.
