Description

The Crime and Disorder Act 1998 requires that an 'Appropriate Adult' is present to support adults 18 years and over when they are: • interviewed by the Police - either as a voluntary attender, or under arrest; and/or • formally read their rights; and/or • formally charged; and/or • finger printed by the Police; and/or • searched by the Police (at a custody centre). Where no adult relative, guardian, carer, friend, neighbour or other adult known to the person (for example social worker, supported lodging host, teacher, etc.) is available, the Act places a statutory duty on local authorities to make provision for the role of 'Appropriate Adult'. The Appropriate Adult service (the Service) will operate in accordance with the legal framework for the rights of people and the duty of care placed upon the local authority, including but not limited to: • PACE Code of Practice guidelines (under Police and Criminal Evidence Act 1984) • Care Act 2014 • Equality Act 2010 Plymouth City Council is looking for an organisation to manage this service
