Legal Justification
The University received no suitable tenders to meet the requirements and conditions set out in the tender documentation in respect of an Open Procedure conducted further to LMU REF: LMU2020-1332 - OJEU REF: 2020/S 115-280658. Tenders submitted either did not demonstrate an economically advantageous solution, meet the contract requirements to ensure operational and financial stability of the contracted services over the applicable contract term, and/or confirm the specification requirements could be fully met. Further to negotiation to identify a service solution that can meet the University's requirements on substantially similar contract conditions, and taking into account value for money considerations and the need to ensure provision of high quality accommodation for University students in suitable proximity for academic terms 2021/22 onwards, the University intends to award a contract to Arcade Holloway Limited further to Regulation 32(2)(a) of the Public Contracts Regulations 2015.

** PREVIEW NOTICE, please check Find a Tender for full details. ** The University intends to award a nominations agreement pursuant to Regulation 32 of the Public Contracts Regulations 2015, under the Negotiated Procedure without Prior Publication which is justified under Reg. 32(2)(a) following an OJEU procurement exercise (Open Procedure) previously conducted in 2020 referred to in Section IV.2.1. The University intends to enter into the contract on or after 27 July 2021 (once a 10 day standstill period has ended; the 10 day standstill period will commence from publication of this notice).
