Legal Justification
The Apache Team, part of the UK Ministry of Defence, has placed a contract with Boeing Defence UK Limited (BDUK) for the long term support of the UK's Apache AH-64E, helicopters and associated maintainer, air- and ground-crew training. It is considered that this Contract can be placed with BDUK using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011) for technical reasons and for reasons connected with the protection of exclusive rights. BDUK, as the platform designer and manufacturer, owns various intellectual property rights connected to the Apache AH-64E variant that it is considered would be required by any third party to deliver the Contract requirements. BDUK has provided no licences to such intellectual property to any other economic operator in connection with the manufacture or support of the AH-64E variant. Moreover, BDUK is the only economic operator with the necessary technical know-how, tools and means, and with the necessary access to essential technical information (including the manufacturing dataset, drawing set and software code to the AH-64E variant), required to provide the services to the required technical and safety standards. BDUK is also the lead system integrator for the USA's AH-64E variant and it is considered that any other economic operator would incur technical and integration risks brought about by a lack of access to wider systems design information
