Legal Justification
In 2018, Hertfordshire Catering Limited (HCL) went out to tender for an off-the-shelf electronic meal ordering and payment system (The Provision of an Electronic Meal Selection, Payments and Kitchen Management System Ref - HCL/IT012), with the aim for this to link to HCL's existing Allergy Management System (AMS) as part of the requirement. After clarification meetings with the three companies that had submitted tender bids, the tender process was abandoned as none of the responses met HCL's requirements and the systems offered could not integrate with the AMS. As this procurement failed to find a suitable off-the-shelf solution HCL reconsidered their requirements and the only option remaining to HCL is to develop and enhance the existing AMS with additional features required as one whole integrated system. The service can be provided only by a particular economic operator for technical reasons as they built the AMS from scratch for HCL.
