Description
This Voluntary Ex-Ante Transparency (VEAT) notice relates to a project to establish an agreement for the Supply, Delivery, Commissioning & Maintenance of Side Stream Filtration Units at the University of Strathclyde. The estimated value of the Contract across a 48-month period is GBP 198,000, exclusive of VAT. It is anticipated that the contract duration will be for an initial 24-month period, with the option to extend for up to an additional two 12-month periods. The Contract is anticipated to commence on the 07 March 2022.
Total Quantity or Scope
The University of Strathclyde ('the University') has recently installed a district heating network, that includes a number of side stream filtration units to maintain a high standard water quality. The University also has some units installed in CHW systems, however, it is anticipated more of these units will need to be procured. This Contract will include, but will not be limited to, the supply, delivery, commissioning & maintenance of side stream filtration units that can fulfill all parts of the following specification; - Filtration to less than 5 microns; - pH Control to maintain pH 9.5-10.5; - inhibits corrosion maintaining less than 1.0mg/l; - that removes air/microbubbles; - that restricts bacterial growth; - has BMS connection; - requires no dosing pots or injection pumps negating the need to carry drums of chemicals through buildings; - has no dosing pots to prevent the need to store chemicals on site; - has a small footprint; - uses back wash that can be connected to a drain or discharge into a gulley; - has a glycol recuperator to recover glycol from cooling systems. The recuperator will automatically pump the glycol back into the cooling system; and - requires no consumables items such as filters.

Legal Justification
A Prior Information Notice (PIN) was published via Public Contracts Scotland (PCS) on 17 October 2021, with a request for interested parties to register their interest no later than 12 noon on 17 November 2021. 6 companies noted an interest by this specified closing date, and as part of market engagement for this opportunity, a questionnaire was issued to those same suppliers. The University has found that based on all questionnaire responses received, only 1 company (Enwa Water Technology UK (UKBR006388)) can fulfill the requirements set out under the Prior Information Notice (PIN). Therefore it has been determined that the appropriate route to market for this requirement is the use of the negotiated procedure without prior publication in accordance with The Public Contracts (Scotland) Regulations 2015, Regulation 33 – Use of the Negotiated Procedure without Prior Publication; - (1) A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases - b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (ii) competition is absent for technical reasons.
