Description

The Council has awarded a contract to Infinity Park Derby LLP for the purchase of land and the construction of an advanced manufacturing and research centre

Total Quantity or Scope

The Council has entered into agreements under which the Council has acquired through a land sale agreement the freehold of land that forms part of Infinity Park Derby for a value including SDLT of GBP 214,133. The site of the facility to benefit from rights of access and use of adjacent drainage and highway infrastructure. The Council has entered into a development funding agreement under which the Council is providing GBP 14,631,629 funding to carry out construction of the research and development facility at the site and associated infrastructure works with building completion intended by February 2023. The agreements are entered into based on exclusive rights of the developer.

Legal Justification

The negotiated procedure without prior publication is being used and is justified under Regulation 32(2)(b)(iii) of the Public Contracts Regulations 2015 for the award of a public works contract for the development of a manufacturing research and development facility. The site acquired by the Council meets the Council's requirements for a manufacturing research and development facility and there are no reasonable alternative or substitute development sites. The works can only be carried out by a particular economic operator because of its exclusive rights as landowner of the land that makes up the development site.
