Description
Babcock Land Defence Limited, acting as agent to the UK Ministry of Defence, intends to negotiate a Single Source Contract with Thales UK Limited for the repair and maintenance of Escapade Vehicle Assemblies. The contract shall be for the duration of 5 years with the option to extend for a further 2 x 1 year options

Legal Justification
It is considered that this contract placement can be placed using the NegotiatedProcedure Without Prior Publication pursuant to Regulation 16(1)(a)(ii) of the Defenceand Security Public Contracts Regulations 2011 (Article 28(1)(e) of Directive2009/81/EC) for technical reasons because;a. Thales UK Limited is part of Thales Group, who are the original equipmentmanufacturer and hold all design drawings/information, technical specifications andtechnical expertise required. Thales UK Limited are the design authority for the vehicleupgraded to the UK Ministry of Defence requirements.b. Thales UK Limited holds all technical documents relating to the UK variant of theEscapade vehicle, and has stated that it is not willing to release these to any othereconomic operator.c. Due to the interoperability requirements of the equipment, the repair andrefurbishment cannot be undertaken without access to the OEM and Design Authoritytechnical documentation, which is not available to third parties, no other party at thiscurrent time would be able to fully support this requirement.
