Description
Provision of In-Service Support (ISS) to Sky Guardian 200D (SG200D).
Total Quantity or Scope
A three year In-Service Support Contract with options to extend for a further two years for Sky Guardian 200 Digital (SG200D) to cover requirements for Apache AH64E and Chinook CH-47 Mk.5 and Mk.6. The Contract will cover delivery of equipment, training, support services and a repair facility for both platforms for the intended period.

Legal Justification
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. The Secretary of State for Defence intends to award Leonardo UK Ltd a contract for a duration of 3 years with options to extend for a further two years for In Service support with the capability to conduct maintenance and repairs of the SG200D. This contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011 for technical reasons. Leonardo UK Ltd is the original equipment manufacturer and Design Authority for SG200D and only Leonardo UK Ltd has at its disposal the necessary technical knowledge, skills, tools and equipment to provide these services. In addition, any modifications to the SG200D must be underwritten by the DA to provide the MoD with the required assurances that the modifications will not compromise either operational effectiveness or system safety.
