Legal Justification
The C17 Command Support and Airborne Equipment Delivery Team (C17CSAE DT), as part of the UK Ministry of Defence (MOD), has a requirement to place a contract for the provision of servicing, repairs, and consumable spares for Oxygen Gas Transfer Units in order to support our existing capability. The specific item type required is used with the Airborne Forces Equipment (AFE) Aircraft Mounted Oxygen System (AMOS) as part of the High-Altitude Parachutist Life Support System (HAPLSS) capability. It is intended to award a new contract up to the value of £320K (excluding VAT) with Gas Boosting Systems Ltd (GBSL) for a duration of 4 years. It has been determined that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. The need to obtain the necessary licenses, tools, test equipment and develop technical expertise to undertake maintenance and repairs, for a system nearing it’s Out of Service Date (OSD) would not be viable without engaging with Gas Boosting Systems Ltd for a significant proportion of the work. This would impact the users’ ability to safely operate the affected air system, which would result in air system capability being lost. In addition, GBSL holds proprietary information which is unavailable to other economic operators. The Contract may therefore only be awarded to this particular economic operator.
