This contract is a concession style contract and as such, the Concession Contracts Regulations 2016 (and the associated thresholds) have been considered ahead of publication of this opportunity. Analysis of turnover has been considered and applied in determining the application of the Concession Contracts Regulations 2016, which states at point 8. (3) that "the value of a concession contract shall be the total turnover of the concessionaire generated over the duration of the contract, net of value added tax, as estimated by the concession granter". Using an appropriately objective method, the Council has determined the turnover of the service to be below the value at which the Concession Contracts Regulations 2016 would be applicable. The methodology is based on two (2) tests per year at an estimated £55.00 per test for the current number of licensed vehicles across North Northamptonshire (612), with an estimated overall 15% increase in number of vehicles over the contract term, to provide a five-year turnover value, which was below the value at which the Concession Contracts Regulations 2016 must be applied. As such, this procurement process is being managed by the Council in accordance with the requirements of its Contract Procedure Rules, as set out in its Constitution.
