Description
Awarding a new contract to CDPSoft Limited (CDP) for the provision of the Housing Related Support (HRS) Gateway IT system, which is used as a database and case management system by Council staff and commissioned service providers who provide housing related support to homeless and vulnerable people. Duration: 3 years from 1st April 2022 to 31st March 2025. Contract awarded using the Negotiated Procedure without publication of a notice under Regulation 32 (2) (b) (ii) of the Public Contracts Regulations 2015.

Legal Justification
The value of the direct award detailed within this report is below the threshold for the application of the Public Contracts Regulations 2015 for the procurement of public services contracts and therefore it is not subject to the full EU procurement rules. However, the Council’s Contracts Procedure Rules 9.1 and 9.2 require competition for procurements valued over £100K and the invitation of at least four written tenders. The decision to award a direct contract with CDP for the continued use of the Gateway system, in preference to a new system design and re-procurement has been subjected to options appraisal. The system is proprietary to CDP soft and as such, only they are able to provide the necessary technical support, maintenance and updates to the system. Furthermore, there is great risk of service disruption should a brand new system be designed and procured, the thousands of case records and re-training requirement for hundreds of staff in commissioned services would not be cost effective.

Negotiated procedure without prior publication The works, supplies or services can be provided only by a particular economic operator for the following reason: • absence of competition for technical reasons. The system is proprietary to CDP soft and as such, only they are able to provide the necessary technical support, maintenance and updates to the system. Furthermore, there is great risk of service disruption should a brand new system be designed and procured, the thousands of case records and re-training requirement for hundreds of staff in commissioned services would not be cost effective. Awarding a contract to CDP for the continuation of the existing system represents best value for money and best use of Council funds and resources at the current time.
