Description

At NGN the programme to upgrade the racking systems has been ongoing for the last 2-3 years. Swinton Technology were originally contracted to do this work as part of a compliant tender process. Subsequent contracts, for reasons of standardization have been sourced via Swinton Technology also for their proprietary equipment. This contract represents a continuation of this work and as such this requirement also needs to be sourced via Swinton for the same reason . i.e. consistency and standardization.

Legal Justification

This VEAT is issued under Reg 50 of the UCR citing the following reason: 50.-(1) Utilities may use the negotiated procedure without prior call for competition in the following cases-(e) in the case of supply contracts for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations, where a change of supplier would oblige the utility to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance
