Description
bpha is seeking to Tender from suitably skilled and experienced suppliers for the provision of Employers Agent services under this six-year framework. This framework seeks to offer the benefits of best practice in contract delivery and collaborative working practices for bpha and other framework users. The framework is to operate across the geographical area of bpha’s operating area and will be open to all UK public sector bodies to access via a Joining Agreement between bpha, the service provider and Pretium Frameworks Ltd, who bpha has appointed to administer the framework for external users on its behalf. Access to the framework will be subject to approval by bpha. The framework is to operate across the geographical area of bpha’s stock and will be open to all UK public sector bodies to access via a Joining Agreement between bpha, the service provider and Pretium Frameworks Ltd, who bpha has appointed to administer the framework for external users on its behalf. Access to the framework will be subject to approval by bpha. … The estimated total value of the Framework is circa £6.6 million. Of this, bpha anticipate expenditure of circa £5.15 million with the remainder estimated from external users.

Legal Justification
The Contracting Authority reserves the right to extend the Framework duration for a total of 6 years (4 years, plus potential 2-year extension). Justification for this is that the nature of the identified projects in bpha’s development programme often have long lead in periods and may involve planning. Therefore, the Contracting Authority may extend the framework for 2 years at their discretion.

The Contracting Authority also reserves the right not to award the Framework. Neither the Contracting Authority nor any person on whose behalf of whom this procurement is undertaken is to be liable for any costs incurred by those expressing and interest or Tendering for this Framework. The Contracting Authority considers that this contract may be suitable for economic operators that are Small or Medium Enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement. The framework is to operate across England and will be open to all UK public sector bodies to access via a Joining Agreement between bpha, the supplier and Pretium Frameworks Ltd, who bpha has appointed to administer the framework on its behalf. The framework will comprise of 1 lot. The framework will be open to any "Authorised User", which are defined as follows: (i) any entity within the same group of companies as the Contracting Authority from time to time (a "the Group Member") (ii) any entity or joint venture company that the Contracting Authority or any other Group Member holds an interest in from time to time (a "the JV") (iii) any Social Housing Provider in the United Kingdom (excluding the Contracting Authority, the Group Members and the JVs); (vi) any supply chain member of any Social Housing Provider in the United Kingdom, including direct labour organisations and suppliers (excluding the Contracting Authority, the Group Members and the JVs); (v) any national, regional or local health authority in the United Kingdom including, without limitation, any NHS the Trust, and any organisation providing a service to these bodies (vi) any local or regional authority in the United Kingdom (including any arm's length organisation or service provider working on their behalf) delivering any public or private sector construction related projects including, without limitation, housing, education, highways and infrastructure work; and (vii) any service provider delivering services to any other Government Agency in the United Kingdom including, without limitation, the Ministry of Defence and the Highways Agency and, in the case of the organisations listed in limbs (iii) to (vii) above, who has entered into an Access Agreement with the Contracting Authority.
