Legal Justification

Due to unforeseen circumstances (Bill delay, Oakervee, COVID) the procurement of DDP has been delayed. To handover designs to the DDP produced under 861/862 and allow for additional project and time critical advanced design prior to handover, the spend on the contracts has increased, and the term of 861 extended. Replacing the consultants is also not possible due to economic reasons 1) interim consultants would not accept liability for previous designs. The designs on handover to DDP are an employer’s risk. Risks of failure to apportion liability between incumbent and interim designers falls on HS2; 2) short interim contracts would risk continuity of service and negative engagement issues with key stakeholders, needed due to additional surveys (which expire/seasonal); 3) interim contracts not suitable for knowledge/experience transfer from 861 and 862 to incoming. Changing contractors between 861/862 and the DDP would duplicate costs in handover and cause issues to HS2/supply chain.
