Legal Justification
The procurement was scheduled to be undertaken as an above threshold open tender exercise. The tender documents had been created as per usual procedure and the project launched on In-Tend (the e-tendering system) on an open basis. For the avoidance of any doubt, the tender was an open tender on the procurement portal so any company could have expressed an interest in the tender. The "Project Wizard" selected on the system was the above threshold service procedure, but the procurement officer made a genuine mistake in that a contract opportunity notice was not created or published as required by the Public Contract Regulations. As above, this was a genuine mistake, but the procurement process undertaken encouraged genuine competition (with 18 interested contractors) and the Council received 4 tender submissions with the winning bidder scoring above 95% following the application of the MEAT process. A standstill period was observed as required by the regulations and the Council can confirm no challenge was made by any of the bidders regarding the outcome.
