Legal Justification
The publication of the Programme for Government in September 2021 indicated a significant increase in capital expenditure of 10bn GBP over 10 years versus the 2.4bn GBP commitment for 5 years in the NHSScotland Capital Programme. This necessitated a review of the proposed replacement NHSScotland Consultant frameworks to ensure that the new Project Manager framework provided a fit for purpose arrangements for the NHSScotland capital programme. The additional demands on NHSScotland Boards during the Covid-19 pandemic resulted in NHSScotland Boards having insufficient capacity to engage on this. This modification is necessary in line with Regulation 72(1)(c) of the Public Contracts (Scotland) Regulations 2015. NHS National Services Scotland deemed that putting in place a short duration framework until such time a strategy was in place for a fit for purpose framework constitutes significant inconvenience and substantial duplication of costs in line with Regulation 72(1)(b).
