Description
The Council currently has a Highways Services contract with Kier Integrated Services which commenced in October 2013. As part of the contract the Intelligent Transport System maintenance and service has been subcontracted to Swarco UK formerly Dynniq UK, for the whole duration of the contract following on from the previous contract through which they also delivered this service to the Council. The Council intends to continue the existing service with Swarco UK for the provision of an intelligent transport system maintenance service for Suffolk's existing ITS portfolio which has been implemented and operates using Swarco proprietary systems and equipment.
Total Quantity or Scope
The maintenance and upkeep of the existing ITS system in Suffolk including but not limited to the following. Fault and Asset Management, Compatible Materials, Equipment and Parts, Emergency and Fault Service, Periodic Inspection, Optical Maintenance, Fault Reporting by the Public, General Maintenance and New and Replacement Installations.

Legal Justification
Swarco UK (formerly Dynniq UK) have been successfully delivering the service since 2001. The service has involved Fault and Asset Management, Compatible Materials, Equipment and Parts, Emergency and Fault Service, Periodic Inspection, Optical Maintenance, Fault Reporting by the Public, General Maintenance and New and Replacement Installations. Suffolk County Council has determined that no other organisation can provide this service and therefore that there is no competitive market because of the need for compatibility with the existing systems including our urban traffic management and control system along with ninety nine percent of our existing ITS assets being Swarco UK equipment. As such, Suffolk has decided to commence a negotiation directly with Swarco to enter into a new agreement, on largely the same terms as the previously procured contract, and intends to finalise such negotiations later this year. Whilst Suffolk CC is confident that its analysis of these circumstances is correct, it remains committed to meeting its public procurement obligations and, in particular, its commitments to transparency and equal treatment. It is therefore filing this notice to ensure that no other service provider believes it could in fact meet the requirements as described above.
