Description
DIO have a requirement to build 7 houses at the AKI site in advance of the SFA workstream A, a future planned procurement (circa 140 houses) and SFA workstream C (circa 800 houses) current running procurement for both design and build. It is proposed to instruct this change, to increase the volume of houses by 7, through the current contract DIOCB1/253. Legal Justification
Further to that set out above II.2.4. The requirement for 7 houses at a valve of €4.6m falls below the DCPCR threshold for works as set out in PPN 10/21, beyond which this required would be subject to the full suite of relations governing public contracts. This requirement on its own is small in volume and value. There are also other procurements running or due to be issued for larger packages of work for housing but also other construction project in support of the APOLLO programme, circa 30 across all the sites. The original housing requirement at AKI was competed under tender ref: DIOCB1/23. A part of the tendering process and as part of their tender submission, tenderers were asked to include additional costed options (DICOB1/23 Booklet 3 pricing Rev 3) to enable inclusion of additional houses (through later instructions) during the life of the subsequent contract, if required. The Current contract awarded through competition includes costed options and the authority's intent is to increase the volume of houses as per the contract. The change proposal has been benchmarked against the original contracts technical and cost criterion to ensure technical capability, capacity and VfM. In addition to the commercial and public procurement regulations the following other deliver considerations were taken into consideration. The current Contractor has met the RIBA 4 design requirements and has procured and contracts in place for the Tier 2/3 supply chain (including labour, equipment, materials, and local logistic). All CDM (H&S) provision are already in place at the AKI site and security clearances in place for the labour force. Due to the programme imperative and risk to life for service families adding this requirement to the current contract brings additional benefits to the project timescales, expediting the build to commissioning/handover period.
