See VTN 2022/S 000-025814 It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful under Regulation 16 (1) (a)(ii) of the Defence and Security Public Contracts Regulations 2011. This is for technical reasons because following a call for competition, only one response to the contract notice (Notice reference: 2022/S 000-018057) was received from Leonardo UK Ltd. In absence of interests from other suppliers, Leonardo UK Ltd is currently the only supplier with sufficient capability to deliver this requirement’.
