Legal Justification
This is a Direct Award under Section 33(1)(b)(ii) of The Public Contracts (Scotland) Regulations 2015 (Negotiated Procedure Without Prior Publication) as, “competition is absent for technical reasons.” Fife Council requires a service to transport school pupils, between Crail and Madras College (St Andrews) and between Lundin Links and Waid Academy (Anstruther). This award, to Fife Scottish Omnibuses Ltd, is to purchase seating capacity for pupils on the existing local bus service (Service 95), which is the only service covering the whole of the area required.
