Description
This is an Award Notice for the Provision of an Income Management System. Civica have provided an income management system that is used by Hertfordshire County Council (HCC) since 2016. This contract has been held by HCC's provider of a Shared Managed Service (SMS). The SMS contract ended on 31st March 2023, and as such the Council needed to maintain this income management system for the reasons stated in IV.1.1.
Total Quantity or Scope
The Income Management System integrates with 15 third party software applications for the payment of services across the organisation. This enables the service departments to use software that provides the business with their requirements together with a payment solution that adheres to payment card industry data security standards; thus providing PCI compliance and protecting the organisation and its customers against fraud. Legal Justification
Hertfordshire County Council (HCC) is relying on Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015 in making this award without prior publication. Regulation 32(2)(b)(ii) permits such an award where competition is absent for technical reasons. The contract between HCC's SMS provider and Civica is for the sole benefit of HCC which continues until 2025. That contract permitted HCC to take a novation to receive the benefit of the services. The services provided are the subject of a high level technical integration into HCC's systems that spread across the work of HCC as a whole. Following the end of the SMS contract, an alternative arrangement had to be put in place. Based on the economic and technical needs of HCC there is not a reasonable alternative to the services received from Civica. Market analysis has been undertaken which shows that no reasonable alternative exists to the contract already in place. HCC intends for a procurement exercise to be undertaken prior to the expiry of the contract in 2025.
