Description
This is a voluntary ex ante transparency notice and is intended to provide notice of Bolton Council's (hereinafter referred to as "the Council") intention to make a direct award of contract for Home Care Services under Regulation 32 (2) (c), to the nine incumbent providers, pursuant to the existing Framework Agreement. This direct award will run for a 14-month period starting from 1st September 2023 and will expire on 30th November 2024. The original opportunity to be admitted to the Framework Agreement was advertised in OJEU ( 2016-000009) and procured under the Public Contracts Regulations 2015. Further details of the services and the Framework Agreement are set out in that OJEU notice.
Total Quantity or Scope
In 2015, the Council awarded a Framework Agreement with two lots to about ten providers following a competitive tender process. The initial term of the Framework Agreement was subsequently extended and is due to expire on 31st August 2023. There are currently nine providers who provide Services to the Council under this Framework Agreement. The intention of the Council is to go out to tender at the end of 2024, so that a new framework agreement will commence from 1 December 2024. At the same time as making these direct awards, the Council will also open up Q068 DPS Home Care Framework. (see section 11.2.14 below for further details).

Legal Justification
Home Care Services in Bolton provide person-centred care to support people to retain or regain their ability to carry out basic tasks of everyday living. The Community Based Support element of the service refers to support provided outside the person's home which includes regaining skills and confidence, to enable participation within the community. These services are for all adults over the age of 18, with a diverse range of presenting conditions, needs and requirements. The Council wish to carry out a wide-ranging review of these services, which will lead to a new service model. The Council needs to extend the current arrangements in order to be able to have sufficient time to carry out this exercise due to the scale of the review which has to take into account the requirements of the homecare market in line with the changing demographic and advancing needs. Nationally, the home care market has been very fragile at intermittent periods during recent years, which have impacted on how health and social care is delivered and may also alter the future service model. The Council needs to ensure continuity of Service in order that it can comply with its statutory obligations during this period. Therefore, the Council has taken a decision to continue to work with the incumbent providers for up to another 14 months. This will provide sufficient time to decide on the new service model so that the Council can carry out a tender Details will be communicated to the market in due course via relevant Contract Notices. The Council will observe a 10-day standstill from the date of publication of this VEAT. It should be noted that Homecare services are also provided to the Council by providers under a separate Dynamic Purchasing System arrangement ("DPS Agreement"). This DPS Agreement was set up in March 2021 and will be extended from 30th November 2023 to 30th November 2024, which is permitted under its terms. At the same time as the direct award is made to the incumbent providers, the Council will re-open the DPS Agreement (Q068 Homecare). This will allow potential providers to request admission onto the DPS Agreement, which will give them the opportunity to bid for and/or to be allocated services.
