Legal Justification
No other reasonable alternative exists for this procurement, as this equipment that is critical to patient care, is highly complex and is an integral part of a large facility. The replacement of which would require extensive structural works and result in significant disruption to the overall facility and the Trusts ability to deliver services. GE Healthcare are the sole supplier of maintenance and sole owner of proprietary information including service, software and updates for this equipment. The absence of competition is not a result of the artificial narrowing of the parameters of the procurement.
