Legal Justification

This VEAT notice is issued for the purposes of recording the aggregated contractual spend with the Consultant that has now exceeded UK Public Procurement threshold for services. The Consultant was initially engaged in December 2022 on a short-term period for a below-threshold consultancy services contractual appointment to support the Council's National Adoption Commissioning Team. Unforeseen demand for the consultancy services support has resulted in two further below-threshold appointments being made to the Consultant in April and July 2023 respectively, to provide continued consultancy services to the Council's National Adoption Commissioning Team. It is evident now that a fourth short-term 3-month appointment to the Consultant is now necessary (circa 1st October 2023 - 31 December 2023) to provide continued consultancy support to the Council's National Adoption Commissioning Team. For the avoidance of doubt the Consultant has been appointed directly under the provisions of Regulation 32 (1)(b)(ii) of the Public Contract Regulations 2015, as competition for this specific type of consultancy services is absent for technical reasons, with the estimated 12 month contractual spend (up to 31st December 2023) totalling £244,860.00 inclusive of VAT.
