Legal Justification
The UK Ministry of Defence has the requirement for a high technology readiness level solution that can detect threat materials in environmental samples with high specificity and sensitivity. Dstl now intends to procure the services of Abionic SA (Switzerland) to enhance the sensitivity of the Abionic MOTS ovalbumin IVD assay. This particular assay is a laboratory test consumable, which is an equipment-specific plastic disposable device that allows the sample to be manipulated and presented to a proprietary instrument: the AbioSCOPE.. It has been designed and developed incorporating task-specific component parts (in this case MoD GFE antibodies in combination with Abionic's proprietary formulation of chemicals) that can be applied to specifically determine the presence of a substance (in this case the model protein, ovalbumin). The procurement of these assays are required to meet specific customer specifications for analysis. A single source justification is deemed necessary in this instance, under Section 34 Regulation 32(5)(b); where the assays are intended to serve as a “(b) addition to an existing installation” (in this instance, the existing AbioSCOPE). A change in supplier would oblige Dstl to acquire supplies of different technical characteristics, resulting in the sourcing of a new instrument and a separate supply of consumables, changes to service support maintenance, as well as disproportionate technical difficulties in its operability (in this instance, changes to current uncertainties reported to our customer). Most significantly, there will be the necessity to fully revalidate methods on to the new instrument, causing an unacceptable burden on resources and a delay in the delivery of high priority work for the CBR S&T programme.
