Legal Justification
The Secretary of State for Defence intends to award a goods supply contract to The Royal Mint Limited for the supply of various promotional materials. This contract shall be delivered through The Royal Mint Limited’s designing and manufacturing of various promotional materials, that shall be created utilising materiel harvested and/or recovered from ex-HMS SWIFTSURE, the first Royal Navy nuclear submarine to be dismantled and recycled. The total estimated value of this procurement is £32,371 ex VAT. In accordance with the provisions of the Public Procurement (Amendments etc.) (EU Exit) Regulations 2020 SI No. 2020/13/19, this procurement shall be regulated under the provisions of the Public Contracts Regulations 2015 (PCR 2015) as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union in no longer appropriate. For the avoidance of confusion, this requirement is within the scope but below the specified threshold of the PCR 2015 It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation(s) 32(2)(b)(i) of the Public Contract Regulations 2015. This is because the proposed contractor’s identity and reputation intrinsically determines the unique character and value of the contract matter and its usefulness in its role as promotional material. In addition, The Royal Mint Limited are already working in partnership with the Defence Equipment Sales Authority to recycle ex-HMS SWIFTSURE, shall be processing materiel from the platform which can be recycled into the contract matter, have pre-existing knowledge of the platform and a strong, pre-existing, working relationship with the Authority.
