Legal Justification
The C17CSAE Delivery Team, part of the UK Ministry of Defence ("MOD"), intends to award a contract to Safran Electronics and Defense ("Safran") for the continued support to BT80, BT380 and BT533 parachute systems including the procurement of spares, re-supply of systems, core maintenance and non-core Post Design Services which includes emergent technical tasks. The estimated value of the contract is £19M for the period 1st April 2024 to 31 March 2028, with the potential to extend the provision by 3 (three) additional Option years. It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 (SI 1848)) on the basis of technical reasons the contract may be awarded to Safran only. The specific equipment items to be supported by this contract are manufactured by Safran as the Design Organization and original equipment manufacturer. Accordingly, Safran is the only economic operator, which has the required technical knowledge, know-how and experience to undertake and discharge the contractor's obligations to support these safety critical systems. Furthermore, Safran has not licensed sufficient rights to MOD or any third party to enable any third party to manufacture any of the systems or any associated spares and is the only supplier who has the ability to provide a compliant airworthiness and safety case to the reasonable satisfaction of MOD. In addition, it is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(3)(a) of Directive 2009/81/EC (Regulation 16(1)(b)(i) of the United Kingdom Defence and Security Public Contracts Regulations 2011) for the purchase of additional goods. This is because the goods are to be provided in addition to existing supplies and a change in supplier would oblige MOD to acquire goods with different technical characteristics, which would result in incompatibility with the supplies already in service, and that with a system service life of 10-years, there are exceptional circumstances which require the period specified in Regulation 16(3) to be exceeded. To note: It is the intention of the Authority to run in parallel to this contract, Project LINOUS to compete the resupply of our precision parachute fleet following expiration of this contract. Project LINOUS will be advertised under separate cover and is expected to achieve Full Operating Capability in ~2030.
