Legal Justification
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) of the Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015). This is for technical reasons in that this contract may not be awarded to any other particular economic operator and no reasonable alternative or substitute exists in order to maintain the continuity of safe high quality health care for the population of Powys. Alternative provision could not be arranged without investing a disproportionate and unreasonable amount of public money to complete a full exercise, to scope appropriate services for the whole population of Powys (partial geographical cover would not be acceptable) and to facilitate any transition. Any potential disruption to the current service model would have a significant impact on the care provided to Powys residents (impacting on the Health and Wellbeing of the population) and would also have a significant impact on neighbouring health care systems to which Powys population pathways are intrinsically linked. Any disruption risks a significant impact on the health services provided to both the Powys population and neighbouring health models and potentially could result in destabilising changes to patient flows. The current service is interlinked with current and other local service provision (at practice and cluster level) and any change to these arrangements would very likely have a significant negative impact on strategic partnership arrangements and delivery against strategic objectives and have a corresponding negative impact on care provided to the population of Powys (significant negative impact on Health and wellbeing of the population).
