Legal Justification
Including the GP direct access pathology services into the main acute contract Retention of the primary care pathology service within the acute trusts supports stability of the acute pathology service, which in turn supports the stability of the emergency department. -Allows certainty for planning purposes -Allows East Coast Pathology Network to progress with plans as an accelerated rate due to the certainty around the contracts in the acute. -Retains the service within the acute trusts which will mitigate the risk of the following: - Realisation of exit costs which would be payable if the service were to move away from the acute trusts - Duplication of services if elements were to be split - Retains scarce pathology human resource within one service and prevents duplication of roles - Prevents disaggregation of IT and records - Realisation of unknown risks

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.
