Legal Justification

The Contracting Authority justifies the direct award pursuant to Schedule 5, Paragraph 7 of the New Procurement Act 2023. The agreement is for repeat consumables specifically designed for Myosure and Fluent Systems by Hologic, which the Trust invested in capital and is in operation at the Trust. These medical devices are used in hysteroscopy and polypectomy procedures, and the associated consumables are exclusively manufactured by Hologic Ltd. The consumables are specialised and fully compatible with the existing medical devices used by the Authority’s Gynaecology Consultants for the treatment of their patients. The Contracting Authority intention to direct award is justified by compliance with Paragraph 7(a) & (b), as switching suppliers would cause incompatibility with existing equipment, leading to disproportionate technical and operational challenges.
