The provision of Maintenance & Technical Support of Programmable Logic Controllers and Control Equipment manufactured and supported by the original OEM of the equipment insitu and in use by Sellafield, including: On-site support, breakdown support, telephone support, servicing, maintenance and associated parts as specified in the install baseinventory and targeted P1 managed between Sellafield and the OEM (the awarded supplier)

Legal Justification

The services can be provided only by a particular economic operator for thefollowing reason:protection of exclusive rights, including intellectual property rightsIs in accordance with PCR 2015 Regulation 32.5(b)."For additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquiresupplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance" The OEM awarded the contract has the intellectual property for the equipment used within context of this contract and has been maintained and managed by the awarded supplier as the Original Equipment Manufacturer (OEM) and own the intellectual property associated with the equipment. This proprietary equipment cannot be modified by another company.
