Description
Scada (Supervisory Control and Data Acquisition) is an industrial control system designed to monitor factory and plant operations. BMS (Building Management System) is a computer-based system to control and monitor the building mechanical and electrical equipment. The maintenance and support services are intended to address any issues related to the control system components mentioned below. These services include essential software maintenance, technical support and services to help protect and extend the software, ensuring smooth operations. EJ Peak, trading as March, provides LondonEnergy support and maintenance for the SCADA and BMS systems at EcoPark South. March will address any issues related to the control system components at the related site. Throughout the contract's lifecycle, if LondonEnergy requires changes or improvements, they will evaluate feasibility and the impact on the existing control system. March designed the Scada and BMS system.

Legal Justification
A direct award as the the Scada and BMS system was designed by March. No competitive tendering procedure took place. Under the regulations, the direct award justification is as follows: The supplier conditions are met in relation to the public contract by: (a)due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required, and (b)there are no reasonable alternatives to those goods, services or works and; The public contract concerns the supply of goods, services or works by the existing supplier which are intended as an extension to, or partial replacement of, existing goods, services or works in circumstances where- (a)a change in supplier would result in the contracting authority receiving goods, services or works that are different from, or incompatible with, the existing goods, services or works, and (b)the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance.
