Legal Justification

This interim contract is being directly awarded on the grounds of unavoidable urgency, following unexpected notice of early termination of a 2.5 year contract by the incumbent provider. Immediate re-procurement of the service was identified as the best option for the council and NHS to continue to fulfil its joint, statutory responsibility to provide short breaks for disabled children. The interim direct award is for 24 months, to bring service stability and provide consistency of care for families. During this period joint commissioners will undertake a flexible, competitive process to re-procure a longer-term provider of residential short breaks services in South Gloucestershire.
