Legal Justification
The procurement did not fall outside the scope of application of the regulation. There was a procedural irregularity that occurred in the tendering of Supplier Hosted Cloud Solution for Merchant Acquiring and Payment Gateway Services. The contract was intended to be advertised through both Contracts Finder and the Find a Tender Service (FTS) under the open procedure. The notice was successfully published on Contracts Finder, and the tender documentation was made publicly available via Pro Contract. 3 valid bids were received and evaluated in accordance with the published criteria, there were a further 25 suppliers who viewed the opportunity. The contract has now been awarded to the successful supplier. However, due to an administrative or system error, the corresponding Find a Tender notice was not successfully published at the time of advertising. This omission was not identified until after the award decision was made. Although the FTS notice was not published as required under PCR 2015 for above-threshold procurements, the process was conducted in an open manner. The opportunity was accessible to the market via Contracts Finder, and no intention was made to restrict competition. The Council is satisfied with the quality of the bids received and the integrity of the process conducted. This notice is being issued with this information to ensure transparency and to acknowledge the procedural issue. It is not an attempt to avoid compliance with procurement regulations, but rather to provide openness and reduce the risk of legal uncertainty. The Council does not consider that the omission materially affected the competition or the outcome of the procurement.
