Legal Justification
This contractor was appointed to carry out upgrades to existing AHU’s through a previous QQ appointment over the past 3 years. To allow the Board to progress with year 4 and potentially 5 of the upgrade programme and to achieve as many upgrades within this financial year, it is beneficial to have continuity with this supplier who has existing site knowledge, availability of supplies with knowledge of the AHU’s and previous issues that have been faced throughout the programme. Continuing with this contractor we are able to achieve continuity of the upgrades to the AHUs which will assist with the maintenance of the building. Applied Public Contracts (Scotland) Regulations 2015: 33.4(b) for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
