Legal Justification
Framework duration. There are a number of reasons for increasing the framework duration including:- • YPO is currently undergoing a significant internal restructure of its procurement function, including changes to its governance and approval processes, category management responsibilities and staffing. This restructure was not foreseen at the time the framework was awarded and has temporarily impacted some procurement activities as the changes are implemented. • At the time when the Framework was originally put in place, YPO were unaware of the start date of the Procurement Act 2023. As a result of initial engagement with customers and suppliers it has become apparent that the scope and reach of the framework may need to change. The extension enables YPO to properly engage with the new Procurement Act 2023 effectively and determine the most appropriate route to market and scope to capture both customer and supplier needs. A PME notice has already been issued under notice number 2025/S 000-010879 and engagement with the market is still ongoing. It is anticipated that a further PME notice will be issued in the coming months. • In addition, YPO are changing procurement systems which was not foreseen at the start of the Framework. The extension enables YPO to run the procurement on the new e-tendering portal rather than YPO having to switch over part way through completion of the tender. The extension is therefore necessary to avoid any such disruption to critical services of YPO's permissible users who use the framework or the supply chain, ensure the replacement solution is procured successfully and to prevent unnecessary expenditure of public funds in repeating partially complete activities such as YPO switch of tendering platforms, or having to re-procure another framework as the new one as the scope and route to market was not right. Change to the framework value. The current spend under the framework is around £4 million pounds. YPO have increased the value of the framework from £5 million to £6.5 million to allow sufficient scope for any customer activities during the extension period and taking into account inflation within the market. The extension of the framework and the increase in contract value in this case guarantees no return economically for any provider. The actual mechanism for how the contract works remains unchanged. Customer buying patterns will determine the actual spend under the framework in the extension period. For transparency YPO is including the corrected organisational details as detailed below. For clarity the framework agreements signed by suppliers match the corrected details in this notice and no changes to the original frameworks or awarded suppliers have been made. • Original Notice had the name of contractor as ABM. The full name of the contractor as per the framework agreement should be ABM Catering for Leisure Limited • Original Notice had the name of contractor as Edward Ridding Web Design which was the suppliers e-tendering portal name. The correct name of the contractor as per the framework agreement should be And Serve Ltd • Original Notice had the name of contractor as Electrolux Professional Foodservice with a NUTS code of UKH2. The correct name of the contractor as per the framework agreement is Electrolux Professional Limited and the NUTS code is UKH21. • Original Notice had the name of the contractor as Falcon Foodservice Equipment which was the trading name of the organisation. The correct name of the contractor as per the framework agreement is AFE Group Limited T/A Falcon Foodservice Equipment • Original Notice had the name of contractor as Hatherley Commercial Services. The correct name of the contractor as per the framework agreement is Hatherley Commercial Services Limited • Original Notice had the name of contractor as HK Projects T/A HK (Kitchen & Bar Solutions) Ltd. The correct name of the contractor as per the framework agreement is HK (Kitchen and Bar Solutions) Limited T/A HK Projects • Original Notice had the name of contractor as Hobart UK.
