Legal Justification
It has not been possible to agree an IAP with provider as per revised NHS England 25/26 Service Conditions by 30th June 2025. Due to the time this has taken, Norfolk and Waveney ICB have been unable to start re-accrediting the provider without a clear plan for current activity.
Other Information
This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR) Health Care Services Regulations 2023. For the avoidance of doubt, the provisions of the Procurement Act Regulations 2024 do not apply to this award. The urgent nature of this modification was not foreseeable by or attributable to the relevant authority. The NHSE further consultation on the NHS Standard Contract was not finalised until 8th May 2025. The new service conditions allowed the commissioner to set an Indicative Activity Plan for the Contract Year where an IAP could not be agreed after a period of time. Because the contract ends part way through the year (31/08/2025) and the financial position an urgent modification has been put in place to allow the commissioner to manage activity for the year and to ensure there is no significant risk to patients who have planned surgery with the provider. This award has no impact on market opportunities for these services to potential new providers, a Direct Award Process B may still be undertaken if a new provider wishes to provide these services to Norfolk and Waveney Service Users.
