Legal Justification
This modification to the contract is permitted under the Provider Selection Regime regulations as the modification is clearly and unambiguously provided for in the original contract, which included the conditions that the Health Squad Service "may be extended beyond this end date, subject to grant funding conditions and confirmation of further funding" and the Macmillan Joining the Dots Service "may be subject to an uplift as per the net tariff inflator set by NHS England/Improvement."
Other Information
This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (PSR) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contract Regulations 2015 and the Procurement Act 2023 do not apply to this award. This contract has now been formally modified. There were no conflicts of interest declared by Officers of the Council who were decision makers.
