Description

North Northamptonshire Council is seeking a suitably qualified and experienced Supplier to provide Leisure Management Services in line with the requirements of its detailed specification for up to five (5) years, in order to bring the end date in line with the contracts for the Wellingborough and East Northamptonshire areas. This alignment will allow North Northamptonshire Council to take an authority-wide view of its future leisure provision over the longer term.

This contract is a concession style contract and as such, the Concession Contracts Regulations 2016 (and the associated thresholds) have been considered ahead of publication of this opportunity. Analysis of turnover has been considered and applied in determining the application of the Concession Contracts Regulations 2016, which states at point 8. (3) that "the value of a concession contract shall be the total turnover of the concessionaire generated over the duration of the contract, net of value added tax, as estimated by the concession granter". Using an appropriately objective method, the Council has determined the turnover of the service to be below the value at which the Concession Contracts Regulations 2016 would be applicable. The methodology considered the known turnover value for three (3) years (pre-2020), divided by 3 and then multiplied by 5, to provide a five-year turnover value, which was below the value at which the Concession Contracts Regulations 2016 must be applied. As such, this procurement process was managed by the Council in accordance with the requirements of its Contract Procedure Rules, as set out in its Constitution.
