Description
The contract is to establish UK-based mRNA vaccine development and manufacturing capability to support the UK's preparedness and resilience for future pandemics and health emergencies. The objective of security of supply in such circumstances is to be met by the construction of a mRNA manufacturing facility sited within the UK which will work alongside UK-based fill/finish providers to supply vaccines. In addition, the contract also includes certain commitments for the supplier to invest in R&D in the field of mRNA vaccines and therapeutics within the UK.

Additional information: Contract value is being withheld due to commercial sensitivity (Reg 50(6)(b) and (c)). Publication may enable competitors to calculate cost per dose. This will commercially prejudice:(i) the supplier in its negotiations with other national governments

Legal Justification
The contract has been awarded under the exclusion in Regulation 15 (Defence and security) of the Public Contracts Regulations 2015. The contract is for protection of the essential security interests and resilience of future United Kingdom pandemic preparedness. The award follows the Authority's press announcement in June 2022 (https://www.gov.uk/government/news/moderna-to-open-vaccine-research-and-manufact...) that it had entered into an agreement in principle with Moderna for the strategic partnership. The Authority is not obliged under the UK public procurement regulations to follow a statutory procurement process because Regulation 15(2)(a) (essential security interests of the UK) of the PCR 2015 applies. This notice is therefore being published on a voluntary basis. Nothing in this notice, nor in its publication, implies any intention or gives rise to an obligation to enter into a statutory procurement process under the UK public procurement regulations.
