Legal Justification
Salvage and Marine Operations (SALMO), part of the United Kingdom Ministry of Defence, intends to award a contract (S&MOCB/9002/707300450) to Forum Engineering Technology (UK) Ltd (‘FET’) for the Provision of a Pre-owned Remotely Operated Vehicle (ROV), Spares and In Service Support. The contract has an estimated value of £5M and a duration of 2 years. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(a)(ii) of the Defence and Security Public Contract Regulation (DSPCR) 2011 for technical reasons. SALMO have determined that currently only FET can supply the ROV that fully meets all the Key User Requirements (KUR’s) which are: Depth rating and ability to upgrade to threshold; Payload Capacity; Operating System and INS – ability to dynamically position; UK Original Equipment Manufacturer (OEM) for Support; good material condition with supporting evidence and the customers operational timescales. The ROV was manufactured and supported by FET as OEM. After completion of a technical assessment, only FET holds all the available technical information (drawings, interfaces, test and calibration specifications/procedures, jigs and tools etc.), and has the technical expertise, knowledge and know-how necessary to assure the safety of the equipment. This information is not available to the Authority as it is owned by FET. The Authority does not have the necessary rights to this information and would be unable to provide a suitable level of details to any third party that would enable them to safely fulfil this in service support requirement without impact to the customers operational timescales.
